君が代起立命令、最高裁再び合憲
卒業式などで国旗に向かって起立し、国歌を斉唱するよう求める職務命令は違憲として、東京都立高校の元教員が損害賠償を求めた訴訟の上告審判決で、最高裁は6月6日、この命令を合憲とする判断を示した。
Top court again backs Kimigayo orders
The Supreme Court has ruled it is constitutional for school principals to order teachers to stand and sing Kimigayo in front of the Hinomaru flag at school ceremonies, rejecting a claim that it violates the constitutionally guaranteed freedom of thought and conscience. The decision by the First Petty Bench on June 6, which followed a similar ruling by another top court panel May 30, finalized the defeat of 13 former Tokyo teachers who had been disciplined between 2003 and 2005 for not following the order to stand and sing the national anthem at school ceremonies and been denied postretirement reemployment.
